9th Circuit Background
In the "ruling" made by a 9th Circuit Court of Appeals panel yesterday, they cited pretty much the ACLU's brief verbatim. They cited Bush v. Gore (which doesn't apply because that was about how to count votes as opposed to this where they oppose the method of voting) and the order issued by Bill Jones, who was Secretary of State (CA) during 2000.
They made it sound that Bill ordered the machines decertified because of the reasons that that the ACLU uses in its brief and because of that, the court should follow suit.

We own the NL West!
Last night, the Giants beat up the Padres AND the D'Backs defeated the hated ones, I mean Dodgers and won the NL West.
Went wire to wire which means the Giants were in First Place in division for the entire season. Impressive!
When we go back to the World Serious, we'll have to sweep whichever hapless team, I mean AL team we wind up playing...

Will of the voters
(as long as they agree with us)
The people in San Francisco last year voted to begin reform of the welfare industry in San Francisco. Care not Cash was going to be the first step and it passed with around 60% of the vote.
Despite a bullshit court ruling that required the Bored of Stupidvisors to pass it on their own, the Bored decided to defy the will of the voters by voting down implementation of Care not Cash. See here and here.
Stupidvisors Gonzelez, Ammianno and Daly voted against the will of the voters. That's a given. Ma has a history of flip flopping on this issue, depending on if there's an election and who talks to her. She worked for Burton for 7 years; his views could be seen as hers. Hall just doesn't like Newsom, so this was a vote to "jam Gavin". Maxwell also voted "no", her reasons are not obvious right now. These liberals are the same people who scream " will of the voters" when it's their issues at stake, but when it comes to other issues they don't agree with, such as Props. 187, 209, Care not Cash and President Bush's election, they claim that it was not the "will of the voters" or "theft", thusly they don't have to abide by the outcomes of these issues.
The people that voted "aye" are mostly Stupidvisors from districts that are up for election next cycle and not safe (meaning that they will have to run competitive campaigns). These districts also voted for Care not Cash so this issue can or cannot be used as a reelection issue, depending on the district. McGoldrick (Dist. 1), Peskin (Dist. 3) and Sandoval (Dist. 11). Supervisors Dufty (Dist. 8) and Newsom (Dist. 2) voted aye as well as backers of the initiative.
So this is what tripling the Stupidvisors' salary gets us....it buys us more of the same. Is this getting our money's worth???

Recall Madness and the stupidity of the 9th Circuit
If you were in San Francisco yesterday, the loud noise you heard was liberals cheering because 3 of the most liberal judges on the 9th Circuit Court of Appeals issued a stay on the recall election (and Gray Davis' career). I don't think Judge Kozinski would have done this...
I read through part of the brief, and I've got to wonder...if these punch card machines that are at the crux of the decision are so defective that it would deprive people of the right to cast a ballot, why didn't the ACLU block the two previous statewide elections after 2000, in the name of the public interest as they did yesterday?
Because Democraps "won" those elections! If Bill Simon had somehow pulled off a miracle, you could be sure that there would have been lawsuits and "voters" complaining about being too stupid to use a punch card machine.
And now since a Democrap is a victim of the people's wrath, all of a sudden, every voter whose county uses a punch card machine is suddenly stupid? Sheesh.
More importantly, what will happen to the absentee votes that were already cast prior to this latest act of stupidity by the 9th Circuit? What about their rights to have their ballots counted? What about MY right to have MY ballot counted?
Remember the liberal mantra, because you're experiencing it right now: "rights for me, none for thee".
And before anyone posts any reference to Bush v. Gore, the recount sponsored by the major newspapers showed that President Bush won. So get over it.

BART back from the Airport
An organization that I am part of was instrumental in building the recently opened BART extension to SFO.
We were invited on a private tour of the facilities two weeks before it opened and it was impressive. Very nice and well thought out, we thought at the time.
Apparently not as many people feel the same way because SamTrans, San Mateo County's transit authority, feels that ridership is lower than BART promised. They complain about the fact that the parking lots are half empty and ridership is not as robust as they'd like.
I can answer these questions thusly:
You're charging for parking, when BART parking is traditionally free. People remember this. They don't want to pay to park in empty lots.
Ridership is not great now because it's low season now and people are not spending as much to go to South San Francisco...
But I did ride the BART to SFO for a trip to LA this weekend. It ran on time. It arrived on time. It left on time. Definitely not a San Francisco transit experience.
Then I got off at the SFO Airport station. Went up top to the AirTrain. It was stuck. Wouldn't move for 6 minutes. Then when it did, it got stuck at the next station. Problem was that we all were in the train behind it and we too were stuck.
After finally arriving, I tried to check in using those ATM like machines that generate a boarding pass. It got stuck in the machine. Took 5 minutes to pull it out with my housekeys.
The worst part was missing the preboard. Waiting sucks. At least the trip back into SF wasn't bad. Just had to wait for 15 minutes for the train and another 30 into town.
Driving's still the best way (or getting someone to pick you up), but this could work in a pinch...
